Approach and values

Eve is calm and professional, and will adopt a firm but open minded approach.  She explores their interests and needs and keeps the Parties focused on constructive negotiation towards settlement.

Eve believes the Parties are central to the process and will build conversations to enable them to explore issues and move forward.  The mediator should not give advice or override the Parties’ views.

Mediation is about enabling Parties to make informed decisions.  Eve uses the joint meeting to better enable each Party to understand how the other side views their case, but also to test their arguments against one another, in a safe (without prejudice) environment.

Eve will always try to speak to the Parties or their lawyer, before the mediation, to ensure they arrive on the day with all the tools they may need to make progress.   This might be a valuation report, historic accounts, plans or title deeds.  It is important that the right people attend on the day.  Those with authority to settle but also those best placed to clarify issues in dispute, together with the professional advisers, should be present where possible.

Eve is persistent and resourceful, working hard with the Parties to keep options open and explore creative solutions to the dispute at hand.  She will keep the Parties focused on finding the best deal possible, on the day.  Eve’s focus is on the bigger picture, adopting a risk management approach and listening carefully to the Parties’ needs throughout the day.

Eve is a passionate advocate for mediation.  Most of her mediations settle on the day, within business hours. If a mediation does not settle on the day, Eve will encourage the Parties to continue discussions under cover of mediation privilege, to try and settle the case shortly thereafter.
